Terms of use

These General Terms and Conditions ("Terms and Conditions") govern the relationship between the seller and the buyer. The seller represents the company PROJEKT IM 2000 doo, with headquarters in Belgrade, Bulevar Vojvode Bojovića 12, registered with the Agency for Business Registers ("Seller"), while the buyer is considered any natural or legal person who buys products from the sales range in business premises, sales facilities or via the Kave Home online store.

1. General information about the seller

Internet sales via the website kavehome.rs are carried out by the company PROJEKT IM 2000 doo with its headquarters in Belgrade, Bulevar Vojvode Bojovića 12, registered under registration number 22081039, PIB 114860083, activity: 4759 - retail sale of furniture, lighting and other household items in specialized stores. For all inquiries and communication with customers, contact e-mail is available: info@kavehome.rs.

2. Payment terms

2.1. When buying products online, the customer is obliged to make an advance payment in the amount of 100% of the total value of the order at the time of ordering the product.

2.2. By signing the purchase order, the buyer enters into a contract for the delivery of goods with the Seller. If the purchase order is not signed or filled in when placing the order, payment of the advance is considered to have established the contractual relationship between the buyer and the Seller.

2.3. The customer can cancel the order by means of a written notice, in which case it is necessary to state his information, information about the item being canceled and the reason for cancellation. The right to a refund of the entire advance payment is valid under the following conditions: for Kave Home warehouse products - if canceled no later than 24 hours after the order was placed; for all Kave Home imported products - also no later than 24 hours from the moment of the order.

2.4. In all other cases, the advance payment will be considered a deposit in case of cancellation. This means that, if the buyer for any reason (except force majeure) withdraws from the contract after the advance payment, the Seller has the right to keep the entire amount, unless the law or internal acts of the Seller stipulate otherwise.

3. Prices

3.1. All prices displayed on the website www.kavehome.rs are expressed in dinars (RSD) and include VAT. For each order, the price that is current at the time of payment confirmation applies. The seller reserves the right to change product prices at any time. Purchases with special discounts and/or promotional offers are made according to the conditions shown on the website.

4. Payment methods

4.1. The customer can make the payment:

I. Payment cards: American Express Intesa Bank; Visa; Visa Electron; MasterCard; maestro; Dina Card;

II. Through the current account according to the issued preliminary invoice.

5. Payment in installments

5.1. The customer can use the option of paying in installments if he uses payment cards of American Express bank Intesa, Visa or MasterCard, without interest calculation, according to the following rules:

I. For amounts greater than RSD 150,000 - up to six monthly installments with American Express;

II. For amounts between RSD 150,000 and RSD 249,999 – up to six monthly installments with Visa or MasterCard;

III. For amounts over RSD 250,000 - up to 12 monthly installments with Visa or MasterCard.

6. Special conditions and benefits

6.1. The seller can offer its customers additional discounts when purchasing goods, depending on the total value of the order or special promotional actions.

6.2. Discounts are applied only to items that are not already discounted, and if there are several different benefits, the one that is more favorable for the customer will be used.

7. Refunds

7.1. If the buyer returns the purchased goods and requests a refund, and previously paid with a payment card, either partially or in full, regardless of the reason for the return, the Seller is obliged to make the refund exclusively through the payment methods VISA, EC/MC, Maestro, Amex and Dina. At the request of the Seller, the Bank will refund the funds directly to the cardholder's account.

8. Conversion Statement

8.1. All payments are made in the local currency of the Republic of Serbia - dinar (RSD). For informative display of prices in other currencies, the middle exchange rate of the National Bank of Serbia is used. The amount that will be charged to your payment card is expressed in your local currency through conversion. The conversion rate is taken from the card organizations and is not known to the Seller at the time of the transaction. As a result of this conversion, there may be minimal differences between the amount charged to your card and the original price shown on the site.

9. Cancellation of purchase

Individual

9.1. In accordance with the Law on Consumer Protection of the Republic of Serbia, the buyer - a natural person who made the order remotely, outside the Seller's business premises and without prior inspection of the product, has the right to cancel the purchase within 14 days from the day of receipt of the goods, by sending a cancellation form. If the goods have already been delivered, the buyer is obliged to return them in the same condition in which he received them, in the original packaging, no later than 14 days from the day of sending the form. The seller is then obliged to return the amount paid to the buyer. The Buyer and the Seller can agree that instead of a refund, another item of the same value will be delivered to the buyer, or an item of lower value with the return of the difference, or an item of higher value with an additional payment of the difference by the buyer.

9.2. Upon receipt of the returned product, the Seller will determine whether the product is undamaged and correct. The buyer is responsible for the decrease in the value of the goods that occurs due to improper handling of the product, i.e. beyond what is necessary to determine the nature, characteristics and functionality of the product. An authorized person at the Seller assesses any damage and reduces the refund in accordance with the determined percentage. If it is established that the product is damaged or defective due to the buyer's fault to the extent that it is not possible to sell it further, the buyer is refused a refund, and the product is returned to him at his expense.

9.3. The consumer has no right of withdrawal in the case of i) delivery of goods manufactured on special request or personalized for the customer; ii) delivery of goods whose price depends on changes in the financial market that cannot be influenced by the Seller and that may occur during the cancellation period.

9.4. The consumer cannot give up the purchased goods if he bought them physically, in the Seller's sales facilities.

Legal entity

9.5. A legal entity may withdraw from a purchase only in the event that there is a defect or non-conformity of the product, in accordance with the Law on Obligations of the Republic of Serbia, with compliance with the prescribed conditions and deadlines.

10. Deficiencies of the goods, i.e. non-conformity of the product

10.1. The seller is responsible for defects and non-conformity of the product in accordance with the Law on Consumer Protection and the Law on Obligations.

10.2. The buyer can inform the seller about the defects of the goods:

· orally at the point of sale where the goods were purchased;

· electronically, i.e. on a permanent record carrier, via e-mail: webshop@kavehome.rs

10.3. With the complaint, the buyer is obliged to submit a digital photo of the damaged parts of the product.

10.4. The seller is obliged to investigate the justification of the complaint without delay and respond in writing or electronically within 8 days (for natural persons) or 30 days (for legal entities) from the day of receipt at the latest.

10.5. In agreement with the buyer, if necessary, the collection of the damaged product will be organized.

11. Delivery terms and conditions

11.1. The seller ships the goods within 3 to 12 weeks, depending on the availability of the item and the quantity.

11.2. The furniture delivery service includes transport to one address.

  • Delivery costs are calculated according to the valid price list of additional services and are charged with the consent of the customer.
  • The seller does not carry out the import of goods and assembly.
  • The seller does not modify, finish, move or arrange the existing furniture.
  • If the customer collects the goods on his own, he is responsible for disposing of the packaging in accordance with the law and regulations on waste disposal.
  • Your order will be delivered to street level. It will not be carried inside a house or building.

11.3. Delivery costs are calculated according to the valid price list of additional services and are charged with the consent of the customer.

11.4. If the delivery is made by courier services, the deadline depends on the courier and is usually up to 7 working days. In that case, the seller does not carry out the installation and installation, and the costs are borne by the buyer.

11.5. The buyer is obliged to point out any technical obstacles when agreeing on the delivery (eg impossibility of access to the building, narrow corridors, doors smaller than 80 cm). In this case, the goods are delivered to the entrance of the facility.

11.6. The seller does not modify, finish, move or arrange the existing furniture.

11.7. If the customer collects the goods on his own, he is responsible for disposing of the packaging in accordance with the law and regulations on waste disposal.

11.8. The seller is obliged to deliver the goods no later than the agreed date. If he does not do so, the amount paid will be returned to the buyer within 7 days. If the buyer is not present during the agreed delivery and the goods cannot be delivered, the Seller is not obliged to re-deliver; in that case, the buyer is obliged to collect the goods on his own.

13. Installation conditions

13.1. The installation of the product is charged according to the valid price list of additional services and is calculated with the consent of the customer, according to the previously defined categorization of the product.

13.2. The customer is obliged to provide enough space for assembly (at least 3 x 3 m), so that the assembly is carried out quickly and without problems; otherwise, the Seller is not obliged to carry out the installation.

13.3. Delivery of furniture to the customer's premises is done in a set state. Assembly crews do not mount goods in an upright position if the space is not adequate.

13.4. If the customer collects the goods independently and performs the installation himself, he is obliged to follow the attached instructions. Products that are assembled contrary to the instructions or with inadequate tools are not covered by the warranty.

13.5. Installation crews do not install mirrors, mirrors and similar parts on the wall for technical reasons.

13.6. The buyer is obliged to check the contents of the package when picking up the goods on his own; subsequent complaints regarding the quantity or damage of the package will not be accepted.

14. Instructions for use and warnings

14.1. Wooden products are mounted according to the manufacturer's instructions. They are sensitive to moisture and should be stored indoors with a relative humidity of between 40%-60% and a temperature of 14ºC-21ºC.

14.2. Do not expose the products to direct sunlight and keep them at least 1 m away from heat sources. Clean the surfaces of wooden products with a dry, soft cloth; for deeper cleaning, use a mild solution of soap and water, always wipe in the direction of the fingers. Wipe up spilled liquids immediately. For refreshment, use the oil from the maintenance set. Pads are used to protect against hot and cold objects. Clean the metal parts with a damp cloth and mild soap, then wipe with clean water and dry. Abrasives, polishes or ammonia-based soaps are not allowed.

14.3. Upholstered fabric products can be cleaned with a vacuum cleaner; stains are removed with neutral chemical agents at a temperature of up to 40ºC.

14.4. Upholstered products made of eco leather, leather and skai are cleaned with a dry sponge or flannel cloth; remove stains with neutral soap and clean water, dry naturally. Dry cleaners, thinners, polishes, oils and ammonia-based soaps are prohibited.

14.5. The furniture is not intended for outdoor use unless otherwise specified.

14.6. Improper use of the product may cause injury.

14.7. Glass elements require special care to prevent breakage and injury.

14.8. Elements with mechanisms and flexible construction (eg chairs with adjustable backrest) require extra care when handling.

14.9. Do not expose the products to elevated temperatures, open flames and heating elements.

14.10. Small parts may pose a choking hazard to unsupervised children.

14.11. The sharp edges of the product require extra attention, especially in the presence of small children.

15. Storage of goods in the Seller's premises

15.1. The customer may decide not to immediately collect the item that he has paid in advance or in full. In that case, at the buyer's request, the items can be stored in the Seller's warehouse without additional charge, for a maximum of 2 months from the date of payment of the advance payment or the entire amount of the price. After the expiration of this period, storage will be charged at the price of RSD 500 for each day started.

16. Reservation of items

16.1. A customer who wishes to reserve unpaid items can do so exclusively in writing at the Seller's points of sale. It is necessary to specify the exact name and code of the article, leave personal data and confirm the request with your own signature. Reservations of items in Kave Home stores are made without an advance payment, and the validity period of the reservation cannot be longer than 24 hours from the moment of reservation.

17. Product warranty

17.1. The seller provides a warranty on the purchased product for a period of 24 months from the date of purchase, subject to proper use and maintenance according to the manufacturer's instructions. A warranty card is delivered with the product.

17.2. The buyer is obliged to keep the warranty card and proof of purchase (receipt, slip, etc.) during the warranty period.

17.3. Warranty rights can only be exercised if the customer has a warranty card at the time of request.

18. Protection of personal data

18.1. On behalf of Projekt IM 2000 doo Belgrade, we undertake to protect the privacy of all our customers. We only collect necessary data about customers/users that are needed for business and for user information, in accordance with good business practices and for the purpose of providing quality service. Customers have the option to decide whether or not they want to be included in mailing lists for marketing campaigns. All data is kept strictly confidential and is available only to employees who need it to perform their duties. Employees are obliged to respect the principles of privacy protection.

19. Protection of data confidentiality

19.1. When entering payment card data, confidential information is transmitted over a public network in a protected, encrypted form, using the SSL protocol and the PKI system, which represents the most modern cryptographic technology at the moment. The security of transactions is guaranteed by the payment card processor, and the entire payment process is carried out on the bank's website. Payment card data is never available to the Seller's system.

20. Marketing activities

20.1. The seller may ask the customer to provide personal data, including e-mail address, city and country, in order to send a periodic newsletter and inform about promotions, new products and other marketing activities.

20.2. Data collected for these purposes will be stored for three years from the date of their submission.

20.3. The legal basis for processing personal data for marketing purposes is the express consent of the person to whom the data refer.

20.4. Consent is given explicitly, by accepting the terms of the Seller's Privacy Policy or when signing up to receive Newsletters and other marketing communications.

20.5. Data collected on the basis of consent will be used exclusively for the purposes specified in the internal procedures of the Seller and will be available only to authorized persons.

20.6. By providing the data, the customer allows the Seller to use them for an unlimited time, without compensation, in order to inform about activities and improve the quality of services. In case of misuse of data outside of the stated purposes, the customer has the right to compensation according to the law.

20.7. Consent can be revoked by sending an e-mail to info@kavehome.rs or by registered mail to the address Bulevar Vojvode Bojovića 12, Belgrade, with the indication "Revocation of consent".

20.8. All objections and comments can be sent by the customer to the e-mail: info@kavehome.rs.

21. Obligation to inform

21.1. By publishing the Terms of Business in a visible place in the business premises and sales facilities of Kave Home, as well as on the official website, it will be considered that the Seller has fulfilled his obligation to inform the customer in accordance with the law.

22. Dispute Resolution

22.1. The seller and the buyer will try to resolve all possible disputes amicably and peacefully, and if this is not possible, the court in Belgrade is competent.

23. General provisions

23.1. The Buyer guarantees the accuracy of all the data he has provided to the Seller and confirms that they are his personal and correct. The seller undertakes to use the customer's personal data exclusively for the implementation of the contract and will not use it for other purposes. The provisions of the Law on Consumer Protection, the Law on Obligations and other valid legal regulations of the Republic of Serbia apply to issues that are not regulated by these Terms of Business.

23.2. These Terms of Business shall enter into force 8 days from the date of publication on the Kave Home website.

23.3. The seller reserves the right to change and supplement these Terms of Business at any time.

24. Intellectual property

All content published on the website www.kavehome.rs, including texts, images and other materials, represents the intellectual property of the Seller or third parties who have given consent to the Seller for its use. Use, distribution or reproduction of the content without the express consent of the Seller is not allowed.
