Belgrade, Bulevar Vojvode Bojovića 12, Belgrade, company registration number: 22081039, tax number 114860083 (hereinafter: the Seller), in the course of its business activities, collects and processes personal data in compliance with applicable laws and other regulations governing personal data protection. The protection and security of the personal data of our customers, clients, and business partners are priorities for the Seller.

1. Definitions

All definitions of terms contained in the Personal Data Protection Act shall apply in this document with the same meaning.

2. Data Controller

The Seller is the “controller” of personal data under the law and regulations on personal data protection and, as the controller, determines the purpose and means of processing personal data and is responsible for the storage and use of personal data in written and/or electronic form.

3. Data Protection Officer and Recipients / Processors

In accordance with legal and regulatory requirements, the Seller has appointed a Data Protection Officer whom you may contact regarding all matters related to the processing of personal data or the exercise of data protection rights, and as its representative. The recipients and processors of your personal data are:

  • the Data Protection Officer,
  • employees of the Seller in the Marketing and Sales Department.

The protection of the privacy of the personal data of users of our website and our products is of the utmost importance to our company. All internet activities related to the Seller’s company comply with the regulations of the Republic of Serbia. By accepting these terms, you give your express consent for the Seller to collect and process your personal data stated in the purchase agreement and/or your data provided for marketing purposes. By accepting these terms, you confirm that you are aware of your right to withdraw this consent at any time.

We will not send you emails to which you have not voluntarily subscribed. We will ensure that you can unsubscribe quickly and easily if you no longer wish to receive emails from our website. The Seller takes all measures to ensure the maximum security of your personal data. Your data are carefully protected against loss, destruction, alteration, falsification, manipulation, and unauthorized access or use. The Seller recommends that all parents or guardians teach children to handle personal data safely and responsibly on the internet. Minors should not disclose their personal data to the Seller without prior permission and consent from a parent or guardian. The Seller will never knowingly collect personal data from minors, nor use it in any other way.

5. Legal Grounds for Processing

The Seller collects and processes personal data on one of the following legal grounds:

  • processing is necessary for the performance of a contract concluded with the data subject;
  • processing is necessary for compliance with the legal obligations of the controller;
  • processing is necessary for the purposes of the legitimate interests pursued by the controller or a third party.

6. Personal Data We Collect

The data we collect depend on the type of contract we conclude with our customer, the customer’s intention to use our services, as well as the customer’s intention to exercise their rights based on legal and regulatory provisions on personal data protection. Primarily, these are data without which we cannot provide the service, and they include at least:

  • first and last name;
  • delivery address;
  • city;
  • postal code;
  • phone number;
  • email address;
  • personal identification number.

If personal data are collected for marketing purposes, they include only:

  • first and last name;
  • address;
  • phone number;
  • email address.

7. Collection and Use of Personal Data

The Seller collects and processes personal data for the purpose of concluding and performing purchase agreements for products and services in its offer, as well as to comply with legal and regulatory obligations, and for the purpose of pursuing its own legitimate interests within lawful business operations.

The reasons why we process personal data for the purpose of concluding purchase agreements and fulfilling contractual obligations are:

  • sale of goods and services;
  • delivery and assembly of purchased goods;
  • sales activities of the Seller;
  • handling and receiving objections, complaints, and claims;
  • other legal obligations arising from the Seller’s business operations.

For all other activities, we will request your additional consent.

8. Rights of Data Subjects

Please note that at any time you have the right to request from the Seller:

  • to request correction and completion of your personal data;
  • to request deletion of your personal data;
  • to restrict the processing of your personal data (by us and/or third parties), in certain processes or entirely;
  • to be informed regarding the correction or deletion of your personal data;
  • to object to the way we process your personal data;
  • to request transfer of your data to another data controller (the right to data portability);
  • to withdraw consent to the processing of your personal data.

In addition, you have the right to lodge a complaint if you believe that the Seller processes personal data contrary to the provisions of the Personal Data Protection Act, to the Commissioner for Information of Public Importance and Personal Data Protection, Bulevar kralja Aleksandra 15, 11000 Belgrade, Serbia, by email at office@poverenik.rs or by phone at 011 3408 900.

9. Personal Data Protection

The Seller takes technical and organizational measures to ensure that your personal data are processed only in a manner consistent with the law and the purpose for which your data are collected and processed.

Access to your personal data will be granted to state authorities, public authorities, and third parties solely in accordance with the Personal Data Protection Act.

10. Retention of Personal Data

The period for which your personal data are retained depends on the purpose for which they are processed.

Data collected on the basis of a concluded contract for the sale of goods or services are retained for 5 years from the date of conclusion of the contract;

Data collected for the purpose of sending an informational newsletter are retained for 3 years from the date the information is provided.

11. Newsletter and Use of Personal Data for Marketing

If you wish to stay regularly informed about news from our company and our website, we may inform you by email about new promotions, new products, and other updates.

The legal basis for the processing of personal data for marketing purposes is the consent of the data subject.

Consent is given explicitly on our website by selecting the option: “I confirm that I agree with the Seller’s Privacy Policy on the website kavehome.com/rs and I agree to receive the Newsletter and marketing communications.”

The data processed on the basis of this consent will be used in accordance with the Seller’s internal procedures and data confidentiality measures, solely for the above-mentioned purposes and only by authorized persons of the Seller. If you wish to withdraw your consent, you must send the withdrawal by email to: webshop@kavehome.rs or by registered mail (with the note: withdrawal of consent) to Bulevar Vojvode Bojovića 12, Belgrade.
